TERMS AND CONDITIONS –

CADBURY CELEBRATIONS DIWALI CAMPAIGN

  1. This Cadbury Celebrations Diwali Campaign (hereinafter referred to as “Campaign“) is an initiative of Mondelez India Foods Private Limited having its registered office at Unit No 2001, 20th Floor, Tower-3 Wing-C, One International Center, Parel, Mumbai – 400 013 (“Mondelez”). Please read these terms and conditions (“T&Cs“) before participating in this Campaign.
  2. Participation in this Campaign is voluntary. You agree that, if you chose to participate in this Campaign, you will be bound by these T&Cs and you acknowledge that you satisfy all Campaign eligibility requirements as provided hereinbelow.
  3. Mondelez has engaged with Jio Platforms Limited (“Jio”) to organize and run the Campaign (hereinafter referred to as “Campaign Partner”) which shall be hosted on the JioEngage platform on MyJio application (hereinafter referred to as “JioEngage”).
  4. Mondelez has partnered with Amazon India Pvt. Limited to facilitate the redemption of coupons offered as part of a promotion activity on the Cadbury Celebrations Pack for the Campaign. Jio and Amazon India Pvt Limited are hereinafter together referred to as “Execution Partners”).
  5. For the purposes of these T&Cs, wherever the context so requires “You” or “You’re” shall mean any natural person who is a Participant in the Campaign, and “We” or “Our” or “Us” or “Mondelez” shall mean Mondelez India Foods Private Limited.

ELIGIBILITY:

You and Your Partner need to fulfill the following eligibility criteria to participate in the Campaign:

  1. You and Your Partner need to be a natural person acting for a purpose outside your business or profession and citizen of India;
  2. You and Your Partner should be an individual legal resident of the Republic of India;
  3. You and Your Partner should be of an age 18 years or above at the time of entry into the Campaign;
  4. You and Your Partner shall be legally competent to enter into a binding contracts under the applicable laws of India.

All who fulfill the eligibility criteria to participate in the Campaign shall individually be referred to as “Participant” and collectively as “Participants”.

Our or Campaign Partner’s or Execution Partner’s and their respective employees, their immediate family members (spouses, domestic partners, parents, grandparents, partners, children, and grandchildren), and their affiliates, advisors, advertising/ Campaign agencies are not eligible to participate or avail any benefits under the Campaign.

DETAILS OF THE CAMPAIGN AND HOW TO ENTER:

This Campaign will commence from 12:00 AM on 7th November 2020 and end at 11:59 PM on 13th November 2020 (“Campaign Period“). Any entries before or after the Campaign Period will not be considered. We reserve our right to cancel/modify/extend the Campaign Period or the T&Cs applicable to this Campaign as per our discretion and without giving any prior notice to You. No claims/questions shall be entertained in this regard. The Campaign shall be available in all states across India.

In order to enter the Campaign, during the Campaign Period, you must visit My Jio application (“MyJio”).

You must follow the following steps to participate in the Campaign:

  1. Users who do not have the MyJio installed on their phone will have to download it from the Android Play Store / Apple Store, as applicable and data charges and expenses of the same will be borne by the user. Jio mobile SIM customers (users) will be automatically logged-into MyJio. Non-Jio users will have to complete the registration through an OTP process after downloading the MyJio. OTP is generated as soon as you submit your Mobile number. In case it is not received, please check the number you have entered and click the ‘Re-send’ button.
  2. If you have seen the notifications/ advertisement or otherwise come across the Celebrations Diwali Campaign Banner on JioEngage, Jio TV, or Jio Cinema you are required to click on the banner which will lead to the Campaign page under JioEngage on My Jio (“Banner”).
  3. You will see a visual of the loading screen with a check box to accept T&C’s. Select that check box and move ahead.
  4. A new Quiz will be set for each day at 12 AM during the Campaign Period.
  5. On entering the Campaign, Quiz for the respective day shall be unlocked.
  • If you are entering the Campaign from 7th to 13th Nov 2020 you will be able to see the status of each days’ Quiz which you have attempted or missed.
  • If you miss the Quiz for any specific day and enter the engagement on subsequent days, you will not be allowed to play the Quiz for previous days that you have missed.

On moving ahead, you can invite or join your partner for a Quiz:

  • Where you invite your partner, as a (“Host”), you need to click on ‘Invite’. Enter you ‘Name’ and select your ‘Avatar’ from available options. You will then enter Quiz Room where you have to select a mode of inviting through native apps available on your device and then send the message with an invite link and unique code with your partner. Wait for your partner to join.
  • Where you want to join your partner (“Invitee”), click on the invite link shared by your partner and you will land on the Campaign page. After accepting T&Cs, you need to click on ‘Join’, enter your ‘Name’, and select your ‘Avatar’ from available options. Then enter the unique code shared in the message. You will join your partner in the Quiz Room.
  • Once Host and Invitee (“individually referred to as Participant(s)”) enter the Quiz Room, Host can start the Quiz.

(vii) Each day Quiz shall have 5 (five) time-barred questions. Quiz questions can be of three types:

a) Text – Both the Participants (Host and Invitee) will have to select answers for a textual question, in sync, from the options available. That is both the Participants have to select the same option to score.
b) Audio – Both the Participants (Host and Invitee) will have to correctly guess, in sync, the audio clip which will play in the background, from the options available. That is both the Participants have to select the correct option to score.
c) GIF/Video – A Participant will have to correctly guess the video/gif from a blurred image which will gradually get clearer towards the timer ends. That is both the Participants have to select the correct option to score.

(viii) Participants can answer the questions in the given time frame/timer shown on the Quiz page. If both partners answer before the timer ends, the next question will be shown. If only one partner answers, and the question remains unanswered after the timer ends, the next question to be shown. If none of the partner’s answers, the next question shall appear after the timer ends.

(ix) At the end of the Quiz, the result screen shall be shown with the percentage ‘Score’ attained (“Quiz Completion”).

Entries through JioEngage:

(i) Jio shall furnish to Mondelez, data provided by the Participants, relevant only to the entry submitted by the Participant, and the Participant hereby expressly consents to the sharing of any such data to Mondelez.

(ii) Mondelēz , and Jio and/or their respective affiliates including their directors, employees, officers accept no liability and shall not be responsible and/or liable in any manner whatsoever in case the Participant is unable to submit his/her entry due to failure on the part of the telecom operator, facility provider, device compatibility etc., or due to capacity constraints.

(iii) All attempts will be made by Jio to protect the data submitted to it by a Participant from loss and corruption, but in the event such data loss happens, Jio may have to continue with whatever data is available, or in any other manner as it may deem reasonable. Mondelez and Jio should not be held responsible for any loss of data or the action taken on account of the same. Mondelez and Jio and/or its affiliates will not be held responsible to make good any such loss or dissatisfaction on account of such loss.

(iv) Jio will take reasonable efforts to ensure that there is no security breach at its end in the course of conduct of submission of entry for the Campaign and/or that there is no data / entry loss and/or any other loss at its end. However, in the event of a security breach and/or data/ entry loss and/or any other loss for any reasons whatsoever, Mondelez and Jio and/or its affiliates will not be responsible or liable in any manner whatsoever for any loss on account of any such instances as may be sustained by the Participant. Mondelez and Jio shall have the right at all times to exclude or disregard any entries submitted during any period where a security breach or data/entry loss or any other loss occurs.

(v) Participant acknowledges that all possible issues may not have been identified by Jio and/or its affiliates and associates and/or JioEngage and agrees to hold harmless Mondelez and Jio and/or its affiliates and associates and/or JioEngage for the application, network, process, technical or any other failures.

(vi) By participating in the Campaign through JioEngage under MyJio, the Participant(s) hereby accepts and agrees MyJio’s privacy policy available at www.jio.com.
(vii) Participant also authorizes Jio to collect his/her personal information including name, address, mobile number, and other biographical information. Personal information of the Participant will be collected, processed, shared, and stored in accordance with MyJio’s privacy policy available at www.jio.com.

(viii) Jio and/or its affiliates accept no liability whatsoever regarding

  1. Cadbury Celebrations Pack / Voucher, product quality, packaging;
  2. suspension of the Campaign by Mondelez;
  3. criteria for determination of the Winner(s) and (iv) any other redressal of grievances, suggestions, and/or concerns from the Participants. Any and all such grievances, suggestions, and/or concerns with regards to the conduct, or any other activity in relation to the Campaign, can be directed towards Mondelez at 1800227080 not later than 7 days from the completion of the Campaign.

All grievances pertaining to the ‘Additional Data Vouchers and 1 Year Recharge Plan worth INR 2121 (hereinafter defined) of Reliance Jio Infocomm Limited (RJIL) can be directed towards Jio at 18008899999 not later than 7 days from the completion of the Campaign. Failure to do so is tantamount to the expiry of any claims in connection with the Campaign submitted by a person. It shall not be open for the Participant to require audit or verification of the information, data, or any other criteria, process, or system adopted by Jio.

PRIZES AND WINNER SELECTION:

Mondelez may at its sole discretion add, delete or modify, without any prior intimation (i) Type and count of Prizes available; (ii) Eligibility criteria for qualifying and winning Prizes; (iii) Count of Winners (hereinafter defined); (iv) Special Terms and Conditions (hereinafter defined) for the redemption of Prizes; or (v) Any other aspect related to Prizes and Winner selection. Subject to the aforementioned, below are the ‘Prizes’ available on offer during the Campaign Period:

A. Daily Prizes:

  1. Additional Data Voucher of 1 GB: Additional Data Voucher of 1 GB shall mean Additional Data Pack of 1 GB provided by RJIL. A total of #15000 Additional Data Voucher of 1 GB shall be distributed during the Campaign which shall be distributed across all the days (“Daily Cap for 1 GB Voucher”) during the Campaign Period as below:
  2. Additional Data Voucher of 500 MB: Additional Data Voucher of 500 MB shall mean Additional Data Pack of 500 MB provided by RJIL. A total of #55000 Additional Data Voucher of 500 MB shall be distributed during the Campaign which shall be distributed across all the days during the Campaign Period (“Daily Cap for 500 MB Voucher”)
  3. INR 50 Off Amazon Coupon: INR 50 off Amazon Coupon shall mean ‘INR 50 off on purchase of Cadbury Celebrations Pack’ from Amazon.in. A total of #200000 Amazon Coupons of INR 50 off shall be distributed during the Campaign (“Available Inventory”).

B. Bumper Prizes:

  1. 1 Year Recharge Plan worth INR 2121: 1 Year Recharge Plan shall mean Jio Recharge Pack of 1 year worth INR 2121 provided by RJIL. A total of #10 Recharge Plans worth INR 2121 shall be distributed at the end of the Campaign.
  2. INR 500 Off Amazon Coupon: INR 500 off Amazon Coupon shall mean ‘INR 500 off on purchase of Cadbury Celebrations Pack’ from Amazon.in. A total of #50 Amazon Coupons of INR 500 off shall be distributed at the end of the Campaign.

Daily Prizes and Bumper Prizes are collectively referred to as ‘Prizes’.


Winner Selection:

Daily Prize Winners: Participants shall be awarded Daily Prizes on Quiz completion with 100% Score i.e.; Participants who have successfully answered all questions and achieved a 100% Score, shall be eligible to win Daily Prize in the below manner:

i. Invitee will get INR 50 off Amazon Coupon on purchase of Cadbury Celebrations Pack, subject to clause (iii); on first come first serve basis until Available Inventory for the Campaign is exhausted.

ii. Host will get any one of the following prizes in sequence below on first come first serve basis subject to clause (iii):

  1. Additional Data Voucher of 1 GB until the Daily Cap for 1 GB Voucher for the day is exhausted.
  2. Additional Data Voucher of 500 MB until the Daily Cap for 500 MB Voucher for the day is exhausted.
  3. INR 50 off Amazon Coupon on purchase of Cadbury Celebrations Pack until Available Inventory for the Campaign is exhausted or if such Host has already won Additional Data Voucher of either 1 GB / 500 MB for the day.

iii. Participants can participate in the Campaign multiple times during the day and Campaign Period, however, each Participant is eligible to win INR 50 off Amazon Coupon only once during the Campaign Period and Additional Data Voucher of either 500 MB or 1 GB only once during each day during the Campaign Period; on first come first serve basis.

Bumper Prize Winners: 

  • At the end of the Campaign on 13th November at 11:59 PM, top 60 Participants who have invited the maximum number of Invitees as Hosts and completed the Quiz with such Invitees, irrespective of the Score attained, shall be eligible to win Bumper Prize in the below manner:
  • The number of Invites / Invitees counted for the Bumper Prize shall only be the ones where Quiz is completed as per clause 2 (III) (ix) by the Host and Invitee i.e.; Participants should reach the result screen where ‘Score’ is generated for the Participants on Quiz Completion (“Successful Invites / Invitees”). A Participant may view the number of Successful Invites made by him/her on the Campaign homepage.
  • Top 10 Participants in terms of a maximum number of Successful Invitee(s) / Quiz completed during the Campaign Period shall be awarded 1 Year Recharge Plan worth INR 2121.
  • Next 50 Participants in terms of a maximum number of Successful Invitee(s) / Quiz completed during the Campaign Period shall be awarded INR 500 off Amazon Coupon.
  • In case of a tie between the top 60 participants with the same number of Successful Invitee(s) / Quiz completed, the Bumper Prize shall be awarded on a first come first serve basis i.e.; the participant completing the maximum number of Quiz first shall be considered for gratification.
  • A Participant can win only one Bumper Prize during the Campaign Period.

Other Rules:

  1. Prizes won will get reflected in the “My Winnings” tab under the “Prizes” section of the Campaign.
  2. 1 Year Recharge Plan worth INR 2121 and Additional Data Voucher of 500 MB and 1 GB will be credited to the account of Winner only if such Winner is an active subscriber of telecommunication services of RJIL on the day of credit and has used such registered mobile number of RJIL to participate in the Campaign.
  3. Special Terms and Conditions applicable for Prizes are given in Annexure 1.
  4. Mondelez may also adopt any other methodology or criteria at its sole discretion for selecting Winners for any of the Prizes.
  5. Prizes remaining unexhausted during a particular day during the Campaign Period may be carried forwarded to subsequent days of the Campaign Period for distribution to Participants at the sole discretion of Mondelez without any prior intimation.
  6. Mondelez may also award additional Prizes over and above the count mentioned in these T&Cs considering the performance of the Campaign, number of Participants landing on the Campaign page, or any other reason whatsoever.
